These terms of use (together with the documents referred to in them) sets out the terms on which you may make use of our website www.westsussexmusic.co.uk (“the Website”), whether as a guest or a registered user. Use of the Website includes accessing, browsing, or registering to use the Website.

The Website is operated by West Sussex Music (“We” or “Us”). We are a limited company with charitable status registered in England and Wales under company number 08524556 and have our registered office at West Sussex Music, Sanford House, 5 Medwin Walk, Horsham, West Sussex, RH12 1AG.

Please read these terms carefully before you start to use the Website, as they will apply to your use of the Website. We recommend that you print a copy of this document for future reference.

4.2.1. that no documents or related graphics on the Website are modified in any way;

4.2.2. that no graphics on the Website are used separately from the corresponding text;

6.7. The views expressed by other users on the Website do not represent our views or values.

7. VIRUSES

7.1. We do not guarantee that our Website will be secure or free from bugs or viruses.

We have not reviewed all of these third party websites and do not control and are not responsible for these websites or their content or availability.

9.2. We therefore do not endorse or make any representations about these other sites, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the Website, you do so entirely at your own risk and We will not be liable for any loss or damage that may arise from your use of them.

10. LIMITATION OF OUR LIABILITY

10.1. Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10.2. To the extent permitted by law, We exclude all conditions, warranties, representations or other terms which may apply to the Website or any content on it, whether express or implied.

10.3. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

10.3.1. use of, or inability to use, the Website; or

10.3.2. use of or reliance on any content displayed on the Website.

10.4. If you are a business user, please note that in particular, We will not be liable for:

10.4.1. loss of profits, sales, business, or revenue;

10.4.2. business interruption;

10.4.3. loss of anticipated savings;

10.5. If you are a consumer user, please note that We only provide the Website for domestic and private use. You agree not to use the Website for any commercial or business purposes, and We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

11. MAKING ONLINE PAYMENTS

11.1. Payments made on the Website are carried out through third parties facilities so that payments are made safely. We will protect your privacy by making your online transactions with Us secure. We will have strict security measures in place to prevent the alteration, loss or misuse of information on our computers.

11.2. When you send Us your payment details, they are encrypted, or changed to unreadable code, on their journey between your computer and ours. So any information you send Us cannot be read between these two points.

11.3. When your payment details arrive they are held securely at our end. Access to your information is carefully restricted. We will only use your card details for the payment concerned. We will not disclose your card details to any third parties other than the bank which processes them for payment.

11.4. Once your credit card company or bank has approved the payment, they will process it within two working days. Once your payment has been authorised, it will appear on a confirmation screen, which you may like to print out or save for future reference.

11.5. To make using the online payments service even more secure We automatically instruct most browsers to no longer cache personal information (i.e. store information in their memory). We are able to do this in the majority of instances but strongly advise that after you have completed making all your payments that you return to the Website homepage using the links on the final payment page.

11.6. Where the browser does not cache information, you may not be able to retrieve the last page you have visited by using the browser’s back button. In some cases you may have to follow additional steps to refresh the page you have seen. Using the navigation buttons on the online payments service pages avoids any navigation problems.

11.7. We comply with the provisions of the Data Protection Act 1998 and our online payments are subject to the tightest security under our control.]

12. EVENTS

12.1. Any events listed on the Website are listed at our sole discretion. We reserve the right to reject or withdraw the listing of any event without explanation.

12.2. We will endeavour to provide up-to-date and accurate information, but will not accept liability for the accuracy or currency of the information provided by third parties or for the content on any linked or related websites.

12.3. Listings of promotional events on the Website should not be taken as an endorsement of those events by Us.

12.4. We will not accept liability for any consequences arising from your attendance at the events listed on the Website. Before attending any event, We recommend you contact the event organiser, at the phone number provided, to confirm dates, locations, and other important information relating to the event.

13. DATA PROTECTION ACT 1998

13.1. In order to register and receive or use some of the services on the Website, you may be required to submit some personal information, such as your name, your postcode and email address. By using the Website you warrant that all data provided by you is accurate.

13.2. We have a legal duty to ensure that the processes are fair and that personal data is kept safe and secure, in accordance with the Data Protection Act 1998. We will not share your personal information with anybody else without your knowledge, unless We are required by law to do so.

14. SOCIAL MEDIA

14.1. We maintain a number of social media sites. These sites are managed by Us in order to provide a regular stream of information, news and service updates and to engage with the public. Unless otherwise stated, our social media sites are managed Monday to Friday during office hours.

14.2. We welcome comments, suggestions and questions raised through the social media sites, however request that you do not use these channels to post abusive, offensive or inappropriate comments. We reserve the right to remove any comment without prior notification.

14.3. We encourage anyone coming across offensive comments to report them to Us on website@westsussexmusic.co.uk.

14.4. We cannot be held responsible for any content which has been posted by a member of the public and We do not endorse these comments or the authors who create them.

15. APPLICABLE LAW

15.1. If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and We both agree to that the courts of England and Wales will have non-exclusive jurisdiction.

15.2. If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
